“Journie to WIN” CONTEST
CONTEST RULES
- The Journie to WIN (the “Contest”) is held in the provinces of British Columbia, Alberta, Manitoba, Saskatchewan, Ontario, Quebec, Newfoundland & Labrador, Nova Scotia, New Brunswick and Prince Edward Island and sponsored by Parkland Corporation (the “Contest Organizer”) from July 17, 2024 (12 a.m. EST) to September 17, 2024 (11:59 p.m. EST), inclusively (the “Contest Period”). The Contest is governed by these rules (the “Contest Rules”).
ELIGIBILITY
- The Contest is open to residents of British Columbia, Alberta, Manitoba, Saskatchewan, Ontario, Quebec, Newfoundland and Labrador, Nova Scotia, New Brunswick and Prince Edward Island who (i) are a Canadian resident, (ii) have reached the age of majority in their province of residence at the time of entry, and (iii) are fully enrolled members of the Journie Rewards program and use the Journie Rewards app, with the exception of the Contest Organizer’s employees, representatives, and agents, those of any company, corporation, subsidiary, or other legal entity controlled by or related to the Contest Organizer’s, the participating establishments, suppliers of materials, promotional, advertising or other service entities relating to the Contest, as well as any member of their immediate family (brothers, sisters, children, father, mother), their legal or common-law spouse, and individuals with whom such employees, representatives and agents are domiciled who are not eligible to participate (the “Participants”). By participating in the Contest, the Participants agree to be bound by the Contest Rules.
ELIGIBILITY
- The Participants’ entries must be received during the Contest Period.

The Participants must enter the Contest as follows (the “Contest Activation Entry”):

The Participants who wish to enter the Contest must do so by activating the “Contest” tile in the “Deals” section of their Journie Rewards app. No purchase is required and only one (1) entry per Participant is permitted by the activation within the Journie Rewards app. The Participant must complete the Contest Activation Entry prior to accumulating Additional Entries and Bonus Entries, as further described below. Multiple Contest Activation Entries by the same Participant with different Journie Rewards accounts will be disqualified. The Contest Organizer reserves the right to disqualify any incomplete, illegible, or fraudulent Contest Activation Entries.

After Contest Activation Entry, the Participants can accumulate additional entries (the “Additional Entries”) as follows:

The Participants can earn Additional Entries for the Contest, by completing a qualifying purchase at one of the Contest Organizer’s participating stores, as defined in section 40 of the present Contest Rules (the “Participating Stores”). A qualifying purchase entails either: (1) a minimum purchase of at least ten dollars ($10.00) in one transaction at a Participating Store, excluding purchases of fuel, EV charging, alcohol, lottery, gift cards, prepaid gift cards and transit tickets; or (2) a minimum purchase of at least thirty (30) liters of fuel in one transaction at a Participating Store (each a “Qualifying Purchase”). In order to accumulate Additional Entries, the Participants must present their Journie Digital Card in the app, enter the phone number linked to their Journie member’s profile or present their 9-digit Aeroplan number provided it is linked to their Journie Rewards app at the time of making the Qualifying Purchase during the Contest Period. Any Qualifying Purchase made during the Contest Period will not be eligible unless the Participant has completed the Contest Activation. Each Participant is limited to one (1) entry per Qualifying Purchase, even if the transaction exceeds spending ten dollars ($10.00) or involves purchasing more than thirty (30) liters of fuel during the same transaction within the Contest Period. However, the Additional Entries can be combined. For example, if a Participant purchases at least ten dollars ($10.00) worth of items at a Participating Store and purchases at least thirty (30) liters fuel at a Participating Store within the same transaction, the Participant would earn two (2) Additional Entries for those Qualifying Purchases. Multiple entries by the same Participant with a Qualifying Purchases are permitted with a limit of two (2) Additional Entries per transaction. The Contest Organizer reserves the right to disqualify any incomplete, illegible, or fraudulent Additional Entries.

The Participants can accumulate bonus entries (the “Bonus Entries”) when making a Qualifying Purchase as follows:
- If a Participant completes a Qualifying Purchase and pays for the Qualifying Purchase with a Canadian Imperial Bank of Commerce (CIBC) linked card to their Journie Rewards account, the Participant shall get one (1) Bonus Entry in addition to the Additional Entry(ies);
- If a Participant completes a Qualifying Purchase and has linked their Aeroplan account to their Journie Rewards app, the Participant shall get one (1) Bonus Entry in addition to the Additional Entry(ies); and
- If the Qualifying Purchase includes any of the following Frito Lays or Pepsi products listed below, the Participant shall receive (1) Bonus Entry per product purchased in addition to the Additional Entry(ies).
The Bonus Entries can be combined. For clarity, if a Participant pays with a Canadian Imperial Bank of Commerce (CIBC) linked card to their Journie Rewards account and has linked their Aeroplan account to their Journie Rewards app, the Participant will earn two (2) Bonus Entries for that Qualifying Purchase in addition to any Additional Entry(ies). The Contest Organizer reserves the right to disqualify any incomplete, illegible, or fraudulent Bonus Entry.
- There is no limit of the number of Additional Entries and Bonus Entries per Participants.

The following prizes (the “Prizes”) are available to be won by the Participants:

A total of one (1) first place prize is available to be won by one (1) of the Participants consisting of two hundred fifty thousand (250,000) Aeroplan points from Aeroplan Inc., one RV rental for one (1) week from CanaDream Inc., one (1) one thousand dollars ($1,000.00) M&M Food Market gift card which will be awarded in the form of ten (10) M&M Food Market gift cards worth one hundred dollars ($100.00) each, one (1) one thousand dollars ($1,000.00) Journie Rewards gift card which will be awarded in the form of four (4) Journie Rewards gift cards worth two hundred fifty dollars ($250.00) each and one (1) forty (40) cents per liter fuel discount applicable on up to two thousand five hundred (2,500) liters of fuel worth a total of one thousand dollars ($1,000.00) sponsored by Canadian Imperial Bank of Commerce (CIBC) which will be uploaded to the Journie Rewards account;

A total of one (1) second place grand prize is available to be won by one (1) of the Participants consisting of one (1) five hundred dollars ($500.00) Journie Rewards gift card which will be awarded in the form of two (2) Journie Rewards gift cards worth two hundred fifty dollars ($250.00) each and one (1) ten (10) cents per liter fuel discount applicable on up to five hundred (500) liters of fuel worth a total of fifty dollars ($50.00) sponsored by Canadian Imperial Bank of Commerce (CIBC) which will be uploaded to the Journie Rewards account;

A total of one (1) third place grand prize is available to be won by one (1) of the Participants consisting of one (1) two hundred fifty dollars ($250.00) Journie Rewards gift card and one (1) ten (10) cents per liter fuel discount applicable on up to two hundred fifty (250) liters of fuel worth a total of twenty dollars ($25.00) sponsored by Canadian Imperial Bank of Commerce (CIBC) which will be uploaded to the Journie Rewards account; and

A total of one thousand (1,000) prizes are available to be won by one thousand (1,000) Participants each prize consisting of one (1) ten (10) cents per liter fuel discount applicable on up to two hundred (200) liters of fuel worth a total of twenty dollars ($20.00) sponsored by Canadian Imperial Bank of Commerce (CIBC) which will be uploaded to the Journie Rewards account.

The following restrictions apply to the Prizes:

Aeroplan points awarded are worth up to seven thousand five hundred dollars ($7,500) and is redeemable under the Aeroplan program for flights and other rewards. The retail value of rewards obtained using Aeroplan points will vary depending on a range of factors including the type of reward issued, details of which may be found at: https://www.aircanada.com/ca/en/aco/home/aeroplan/legal/terms-and-conditions.html Aeroplan points have no value prior to their activation by Aeroplan Inc. Aeroplan Inc. shall provide the Winner the Aeroplan points via a digital certificate and the Winner must redeem the digital certificate prior to June 30, 2025. By entering the Contest, the Participant acknowledges and agrees that the Contest is in no way sponsored, endorsed, administered by, nor is associated with Aeroplan Inc., its parent company Air Canada, and each of their respective subsidiaries and affiliates. Contest Organizer and Aeroplan Inc., its parent company Air Canada, are not responsible for any lost, stolen, or damaged Aeroplan points. RV rental is valid at the following participating locations in Vancouver, Calgary, Whitehorse, Edmonton, Toronto, Montreal and Halifax: https://www.canadream.com/locations/ and the prize is worth up to five thousand dollars ($5,000). The RV rental has no value prior to their activation by CanaDream Inc. The RV rental must be activated by CanaDream Inc. The Contest Organizer and CanaDream Inc. are not responsible for any lost, stolen, or damaged RV rental. The RV rental is not redeemable for cash and no refunds will be available. Winner must book their RV rental prior to June 30, 2025. The fuel discount is valid in Participating Stores. The fuel discounts have no value prior to their activation by the Contest Organizer and it must be uploaded by the Contest Organizer to the Winner’s Journie Rewards app. Once uploaded, discount will be automatically applied on your fill-ups, when the Journie Rewards membership is identified at time of transaction, until the maximum savings have been reached. Discount expires one year from date of issuance. The Contest Organizer and Canadian Imperial Bank of Commerce (CIBC) are not responsible for any lost, stolen, or damaged fuel discounts. The fuel discounts are not redeemable for cash and no refunds will be available.

The Winner may be required to provide certain personal information for Prize fulfillment.

The Prize cannot be split, is non-transferable and must be accepted as such, without possibility of substitution.

Odds of winning depend on the number of eligible entries received during the Contest Period.
DRAW

A random draw to award the Prizes will be held by a third party designated by the Contest Organizer on September 24, 2024, 2:00 PM EST (the “Draw Date”) at 25 King Street West Commerce Court, 20th Floor, Toronto. On the Draw Date, one thousand three (1,003) entries will be randomly selected from a server-generated list of all entries.

The Winners, as defined below, shall be announced at journietowin.ca.
HOW TO CLAIM A PRIZE

Once selected for a Prize, the selected Participants must, before being declared an official winner (the “Winner”):
-
be available to be reached by email, with the email address they used to register their Journie Rewards account, within seventy-two (72) hours of the Draw Date. The Contest Organizer will not attempt any additional communication with the Participant if he/she/they cannot be reached. The Participant who does not comply with section 15 c) of the Contest Rules will be declared ineligible to receive the Prize and another draw will be held to award the Prize. The same terms and conditions of the present section of the Contest Rules apply to any subsequent draw;

correctly answer the mathematical skill-testing question without assistance of any kind that will appear on the liability waiver form (the “Waiver");
-
sign the Waiver stating that he/she has read, understood, and complied with the Contest Rules. The Contest Organizer shall send the Waiver by email to the Participant, and it must be returned to the Contest Organizer within five (5) days of its receipt; and
-
on request and in a timely manner, provide a piece of photo ID for verification purposes.
Upon receiving the duly signed Waiver, the Contest Organizer will notify the one thousand three (1,003) Winners of the manner in which he/she may obtain the Prize(s). If a Winner is found to be in violation of any of the aforementioned conditions or any conditions stipulated in the present Contest Rules, he/she will be disqualified and a new draw for the Prize(s) will be held until one thousand three (1,003) Participants are selected and declared the Winners.

Currency. All amounts in the Contest Rules are in Canadian dollars.

Verification. The entry through a Contest Activation Entry, Additional Entries and Bonus Entries, as well as the Waiver are subject to verification by the Contest Organizer. Any entry through Contest Activation Entry, Additional Entries and Bonus Entries, or Waiver that is, where applicable, incomplete, illegible, reproduced mechanically or by hand, damaged, fraudulent, obtained from an unauthorized source, submitted or sent late, featuring an invalid email address or telephone number, not having the correct answer to the mathematical skill-testing question, or otherwise non-compliant, will be rejected and will not be eligible to enter the draw or win the Prize.

Responsibility. The Contest Organizer is not responsible for documents that have been misdirected or sent in late by Participants or received late by the Contest Organizer.

Disqualification. The Contest Organizer reserves the right to disqualify a Participants or cancel one or more entries of a Participant if he/she enters this Contest or tries to do so by any means contrary to these Contest Rules or which would be unfair to the other Participants (e.g., entry by fraudulent means, entries received after the Contest Period). Such Participants may be reported to the appropriate legal authorities.

Running of the Contest. Any attempt to sabotage the legitimate running of the Contest constitutes a violation of civil and criminal laws. Faced with any such attempts, the Contest Organizer reserves the right to reject the Participant’s entries and to seek reparations pursuant to the law.

Acceptance of the Prize. The Prizes must be accepted as described in these Contest Rules, and cannot be transferred to another person, in whole or in part, or substituted for another prize. Once the Prize has been awarded, the Winner will have no further recourse against the Contest Organizers as well as Aeroplan Inc., its parent company Air Canada, CanaDream Inc. and Canadian Imperial Bank of Commerce (CIBC).

Award of the prize. In the event that the Contest Organizer is unable to award the Prizes as described in these Contest Rules, for reasons unrelated to the Winner, the Contest Organizer reserves the right to award similar prizes of equal value or, at its sole discretion, the value of the Prizes indicated in these Contest Rules in cash.

Limitation of liability: participation in the Contest. The Participants agree to release the Contest Organizer including participating Chevron, Fas Gas, Pioneer and Ultramar stations, and On The Run and Marché Express convenience stores, Aeroplan, its parent company Air Canada, CanaDream Inc. and the Canadian Imperial Bank of Commerce (CIBC) and each of their respective affiliates, subsidiaries, advertising and promotional agencies, officers, directors, employees, agents, representatives and subcontractors (the “Released Parties”) from any and all liability for any damages, claims or actions, losses, fines or legal costs which arise, directly or indirectly in connection with the participation in the Contest and the administration thereof, including those resulting from the acceptance, use or misuse of the Prize and any related activity whether or not in compliance with these Contest Rules. Prior to obtaining their Prize, the Winners agree to sign a Waiver in this regard.

Limitation of liability: Prize providers. By entering the Contest, Participants acknowledge and agree to release from liability Aeroplan, its parent company Air Canada, the Canadian Imperial Bank of Commerce (CIBC) and CanaDream Inc., each of their respective subsidiaries and affiliates, and each of their respective officers, directors, employees, agents, representatives, subcontractors and affiliates with respect to any claims or actions, losses, fines or legal costs which arise, directly or indirectly in connection with the Contest. Participants acknowledge that the Contest Organizer is fully responsible for the conduct and administration of the Contest prizes and any related activity, including the selection of Winner(s) and the distribution of Prizes.

Limitation of liability: running of the Contest. The Released Parties are not liable for faulty computer components, software or communication lines relating to the loss or absence of network communication, or relating to any transmission that is faulty, incomplete, incomprehensible, or deleted by any computer or network, and that could limit the possibility or prevent any Participant from entering the Contest. Furthermore, the Released Parties are not liable for any damage or loss that may be caused, directly or indirectly, in whole or in part, by the downloading of any Internet page or of any software or other program, and by the transmission of any information related to participating in the Contest.

Modification of the Contest. The Contest Organizer reserves the right, at its sole discretion, to cancel, terminate, modify, or suspend this Contest, in whole or in part, in the case of an event or any human intervention that could corrupt or affect the administration, safety, impartiality, or the running of the Contest as foreseen in these Contest Rules, subject to the approval of any provincial or federal legislation, if applicable (the “Legislation”). In any case, the Contest Organizer and the Released Parties cannot be held liable for cancelling, terminating, modifying or suspending this Contest, in whole or in part, in compliance with these Contest Rules.

End of participation in the Contest. In the event that participation in the Contest must be ended, in whole or in part, for any reason whatsoever, before the Contest Period set out in these Contest Rules, the draw could take place, at the Contest Organizer’s sole discretion among the entries duly received as at the date of the event that put an end to participation in the Contest.

Authorization. By participating in this Contest, the Winners authorize the Contest Organizer and their representatives to use, if required, their name, photograph, image, voice, place of residence, biographical information and/or declaration regarding the Prize for advertising purposes, without any compensation whatsoever. A statement to this effect will be included in the Waiver.

Limitation of liability: participation in the Contest. Any Participant or individual who tries to participate in this Contest releases the Released Parties from any and all liability for damages that he/she may incur as a result of participating or trying to participate in this Contest including (1) any incorrect or inaccurate information, whether caused by the Participants or by any of the equipment or programming associated with or utilized in the Contest, (2) any unauthorized access to or alteration of entries, or (3) any errors or omissions in the administration of the Contest or the announcement of the Winner.

Prize limit. In all cases, the Contest Organizer shall not be required to award more prizes or to award a prize other than the one described in these Contest Rules.

Communication with Participants. No communication or correspondence will be exchanged with the Participants during this Contest, other than those stipulated in these Contest Rules, or if initiated by the Contest Organizer.

Personal information. The Participants’ personal information collected for the purposes of the Contest will be used only to administer the Contest and no commercial or other communications unrelated to the Contest will be sent to the Participants, unless they have otherwise consented to such communications. Exclusive property. The entry through a Contest Activation Entry, Additional Entries and Bonus Entries are the property of the Contest Organizer and shall not be returned to the Participants and Winners.

Identification of Participants. For the purposes of these Contest Rules, the Participant is the person whose name is registered to the Journie Rewards account and the person to whom the Prize will be awarded if he/she is selected as and declared the winner.

Decision of the Contest Organizer. All decisions of the Contest Organizer or those of their representatives regarding this Contest are final and binding, subject to any decision by courts in relation to matters under its jurisdiction.

Governing Law and Jurisdiction. These Contest Rules shall be governed by and construed in accordance with the Legislation of the place of residence of the Participant. Any disputes arising under or in connection with the Contest shall be subject to the exclusive jurisdiction of the courts of the place of residence of the Participant.

Divisibility of sections. If a section of these Contest Rules is declared or deemed illegal, unenforceable or invalid by a competent court, that section shall be considered invalid, but all unaffected sections will be applied within the limits of the law.

Acknowledgement. By participating in the Contest, the Participants acknowledge that they have read, understood, and agreed to these Contest Rules.

Language. For Quebec Participants, in case of a discrepancy between the French version and the English version of these Contest Rules, the French version shall take precedence.
